Area Court Grade 1, sitting in Karmo has further adjourned the case against Hon. Ahmed Abubakar Ndakene. Babako's (the complainant's ) Lawyers in a curious move asked the court to transfer investigation in the case they instituted against the Honourable Member representing Edu/Moro/Patigi Federal Constituency.
You may recall that the Court ordered investigation into the matter and declined to prosecute Hon. Ndakene without investigation.
The police, who had since commenced investigation into the matter asked the Court to give them additional one week to complete their investigations.
Babako's Lawyers however objected to this, citing contempt of court on account of the inability of the police to produce the report of the investigation and asked that the case to be transferred from Utako Police Division to a higher Division.
Ndakene's Lawyers who berated this approach referred the Court to the provisions of Section 36 of the 1999 Constitution of the Federal Republic of Nigeria (as amended) and Section 1 (1) of the Administration of Criminal Justice Act (ACJA) 2015, which emphasised the need for fair hearing and substantial justice.
Ndakene urged the court to discountenance the application by Mahmud Hassan Babako and grant the request by the police to submit their reports, as granting such application will further delay the matter and cause further distraction to the Lawmaker.
The court adjourned the case to the 6th day of July, 2020 for ruling on Babako's applications while awaiting police report on the investigation. The court based the adjournment on the fact that parties had joined issues and it had become imperative that he deliver a ruling on the issues raised.
